Who are we?
Securex Integrity asbl, free social insurance fund for self-employed workers, hereinafter referred to as "Securex Integrity", with registered office at avenue de Tervueren 43, 1040 Brussels, VAT BE 0409.861.127, Brussels RLP, and which can be contacted by e-mail at integrity@securex.be.
Securex Integrity is committed to processing your personal data in accordance with Regulation (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (hereinafter "General Data Protection Regulation").
Securex Integrity attaches foremost importance to the protection of personal data and to your feedback.
Why do we process your personal data?
Securex Integrity processes your personal data in order to manage your social status and, where applicable, that of your company. As part of this, we collect your social security contributions and ensure that your health insurance fund, your family allowance fund, and the NISSE pension service get all the information they need to pay your entitlements.
What is the legal basis for processing personal data?
The legal basis for the processing of your data is the affiliation contract signed by you and/or your company with Securex Integrity for the purpose of your affiliation as a self-employed worker (or assistant, spouse or partner) and/or that of your company to Securex Integrity in application of the legislation on the KBSZ/BCSS or Crossroads Bank for Social Security (CBSS) and the legislation on the social status of self-employed workers.
The legal basis for processing your data as a self-employed worker, assistant, partner, or declarant on behalf of a company affiliated to Securex Integrity is the legitimate interest with regard to
- Customer Contract and Relation Management: for commercial operations, management of data and their optimisation and automatisation.
- Direct marketing activities: to promote Securex Integrity's services, as well as those of the other Securex entities, to its customers.
How long will your personal data be stored?
Your data are stored by Securex Integrity during the processing of your request and for the duration of the performance of the affiliation contract and for as long as necessary to assess your rights and obligations.
What data are processed?
"Personal data" can be defined as any information relating to an identified or identifiable natural person (data subject).
Securex Integrity processes the following personal data about its customers:
- Social and administrative data (including surname, first name, national registration number, date of birth, address, company number).
- Contact details: address, telephone number, e-mail address.
- Professional data.
- Financial data.
These personal data may be supplied by you, a partner, your accountant, or tax advisor, or through a link with the Crossroads Bank for Social Security (CBSS).
With whom may we share your data?
Within the limits set out below, Securex Integrity shares certain personal data with the intermediary (accountant or tax advisor) to whom you may have given power of attorney to manage your data, with our lawyer as well as with the competent authorities.
Some of your data are also transmitted to subcontractors, who provide certain services in the strict context of a subcontract and for the sole purpose of providing technical assistance to Securex Integrity.
Securex Integrity transmits to the other legal entities making up the economic entity of SECUREX Group, all personal data necessary or useful for the performance of the affiliation contract or separate contracts concluded between the affiliate and these legal entities. Securex Integrity also forwards the contact details of its affiliates to Securex Group asbl, to enable the latter to offer affiliates specific insurance products for self-employed workers and companies (direct marketing).
How are your personal data protected?
In accordance with current legislation, Securex provides an adequate level of protection for your personal data. These measures include the technical and organisational measures required to protect your personal data against accidental or unauthorised destruction or accidental loss, as well as against modification, access, and any other unauthorised processing of your personal data.
Nevertheless, Securex wishes to inform you that no security system can guarantee 100% security. However, if you have any questions or comments about the confidentiality and security of your personal data, please feel free to contact us.
Can your data be transmitted to third countries (outside the EEA)?
As a matter of principle, Securex Integrity does not transfer personal data to countries outside the EEA.
Should it nevertheless be necessary to transfer data to a country outside the EEA, Securex Integrity will implement appropriate safeguards in accordance with data protection legislation and ensure that data subjects have enforceable rights and effective remedies.
In order to guarantee data subjects enforceable rights and effective means of redress, processing and transfer may only take place under one of the following conditions:
- The transfer takes place to a country that ensures an adequate level of protection based on the European Commission's adequacy decisions.
- The transfer goes to a (sub)processor to which binding business rules apply. These company rules guarantee an adequate level of protection.
- The transfer is made to a subcontractor with whom a standard agreement has also been concluded (see "Standard contractual clauses") (EU) 2021/914 of 4 June 2021)) and for which an additional risk analysis has also been conducted beforehand. The contractual clauses and any additional measures following a prior risk analysis or data transfer impact assessment should therefore provide the necessary data protection guarantees.
If there are no appropriate guarantees as to the level of protection, Securex Integrity will only transfer (or cause the transfer of) personal data to such third countries with the consent of the data subject.
What are your rights?
You can find out what data are processed by Securex Integrity and, if necessary, have these rectified by sending a dated and signed request, together with a copy of both sides of your identity card, by e-mail to privacy@securex.be or by post to Securex Group, Data Protection Officer, avenue de Tervueren 43, 1040 Brussels. You may also, in accordance with the same procedures and within the limits set by the GDPR, object to the processing of your data or request that such processing be restricted. You also have the option of requesting that your data be erased or transferred. Further information is available at the same address.
