Who can make use of this bike leasing?
The bike leasing scheme is available only to employers and employees of the joint subcommittees 331.211 and 331.213; who are recognised or subsidised by the Flemish Community or the Flemish Community Commission. This includes, among others, centres for birth control, tele-on-call, adoption, mental health care, and consultation offices for young children. The childcare sector is currently excluded from this scheme.
Conversion of the year-end bonus
Your employees can choose to convert their gross year-end bonus (including the employer's social security contribution) either fully or partially into a bike leasing budget. This budget can only be used for leasing a bike and not for any other purposes. If your employee does not take this option, the year-end bonus will simply be paid out.
The conversion is only possible if a company collective agreement is established within your company.
Note: If your employee opts to convert their year-end bonus into a bike leasing budget, they forfeit their year-end bonus (or part of it) for the entire duration of the lease contract.
Maximum budget
The collective agreement sets a limit on the portion of the annual year-end bonus that can be used for bike leasing.
The maximum amount corresponds to the total cost of a lease bike valued at up to 12,428.40 euros over a period of 3 years. This amount is indexed annually (in October) based on changes in the consumer price index.
If the year-end bonus exceeds this limit, the remaining balance will be paid out in cash.
How to implement bike leasing in your company?
The collective agreement outlines how you must implement bike leasing in your company and what must be included in the agreement. You will need to follow several steps.
Step 1
Before implementing bike leasing, you should first check if there are better collective alternatives, such as a group purchase or bike rental through the employer. This consultation is mandatory if there is a company council, CPPW, or trade union delegation. If those options are insufficient, you can proceed to individual bike leasing.
Step 2
Next, you must provide your employees with clear information so they can make an informed choice. This information should preferably be given in writing and must include certain mandatory elements: the cost, the impact on salary and the year-end bonus, the consequences in case of suspension of the employment contract or early termination of the lease contract, and the conditions for taking over the bike at the end of the contract. Finally, you must provide an annex to the employment contract of the employee that clearly describes the details of the salary conversion.
Step 3
Additionally, you must establish a bike leasing policy that clearly outlines all rights and obligations of the employee. This should be done in consultation with the social partners.
