Towards a mandatory check-in and check-out in construction from 2027

From 2027 onwards, attendance registration on construction sites will be stricter. In addition to the mandatory registration upon arrival, departure will also need to be registered. With these new rules, the government aims to fight social dumping and improve safety at construction sites.

Are these measures already official?

Not yet. In this article, we discuss a draft bill, for which the proposed text still has to go through several stages. Until this legislative process is completed, the proposed measures may still change and do not yet have legal force. Through Lex4You, we will keep you informed of further developments.

What exactly is it about?

In the construction sector, a mandatory attendance registration on construction sites (the so‑called check-in-at-work) has been in place since April 2014. Attendance registration means that you record who is present on the construction site and at what time. Through Checkinatwork, all natural persons performing works in immovable property on a site must be reported electronically, and this applies to all sites with a total cost of at least 500,000 euros (excl. VAT).

With Checkinatwork, employers and contractors register the daily presence of their employees, subcontractors, and self‑employed subcontractors. These individuals can also register themselves, and this must always be done before they start working.

What exactly is changing?

In certain sectors, such as cleaning and moving services, a mandatory IN and OUT registration already applies. This obligation is now being extended to construction works involving immovable property. Advance registration will be prohibited, and from now on every person present must register themselves in real time at the start and at the end of the activity. Breaks do not yet need to be registered.

From 2027 onwards, as an employer you will no longer be allowed to register your employees’ attendance in advance and remotely. The new extended registration must take place in real time, specifically by the worker themselves on construction sites at every moment marking the start and end of their activity.

Self‑employed workers and assistants

If it concerns a self‑employed person or an assistant, the company number of that self‑employed worker or of the company they are assisting will also be displayed.
