Mandatory mobility budget: not before 2027

During the last council of ministers in 2025, the ministers provided more clarity regarding the mobility budget. This budget must be implemented by companies with at least 50 workers starting from 1 January 2027. Companies with 15 to 50 workers have until 1 January 2028 to comply. This obligation does not apply to smaller companies.

What does the mandatory mobility budget entail?

There is still not much clarity regarding the mandatory introduction of the mobility budget. The Council of Ministers has made the decision, but no draft texts of the decision are available yet.

First condition: providing a company car for at least 36 months

What we do know is that the obligation applies only to employers who already have company cars. Currently, the mobility budget can still be introduced voluntarily. One of the conditions for voluntarily introducing that budget is that you as an employer have already provided company cars for at least 36 months.

This condition will also be important in determining whether you as an employer must introduce a mobility budget. Do employees in your company already have a company car for at least 36 months? Then you may be required to introduce a mobility budget.

Second condition: having a certain number of employees

A second condition for the mandatory introduction of a mobility budget relates to the number of employees in your company.

Do you have at least 50 employees in your company and do you meet the first condition? Then you must introduce a mobility budget by January 1, 2027 at the latest. Employers who meet the first condition and have between 15 and 50 employees must introduce the budget by January 1, 2028 at the latest. Employers with fewer than 15 employees will not be required to introduce a mobility budget.

Based on the information we currently have, the obligation and the implementation date will be based on the total number of employees in your company, not on the number of employees with a company car.

Are there any other conditions to consider?

Undoubtedly, additional provisions and details will be included in the final text of the law.

Since the text on which an agreement was reached in the Council of Ministers will be sent to the Council of State for advice, we do not yet know those details. After that, the text will be discussed as a draft law in parliament.

From that phase, we can provide more details. As soon as there is more information about the mandatory introduction of the mobility budget, you will read it on Lex4You.

Can you as an employer take action sooner?

Absolutely. The obligation to introduce a mobility budget will not come into effect until at the earliest 2027. However, nothing prevents you from checking now whether you can introduce a mobility budget. The implementation of such a budget always takes some time. So the sooner you start the preparation, the better.
