The day of the event
Your worker is entitled to be absent on the day of their child’s solemn communion or their participation in the secular youth festival. If this event takes place on a Sunday, a public holiday, or a usual day of inactivity, the law still allows the worker to be absent on the usual working day immediately before or after the day of the event.
These rules do not apply in the case of a first communion or a private communion.
… of their own children
By "their own children" we mean the child of your worker, the child of their spouse, or their legally cohabiting partner.
The adoptive or legally recognised natural child is treated the same as a legitimate child. Likewise, the person with whom the worker cohabits legally is treated the same as a spouse.
Only one day of short leave is granted, even if several children take part in a communion or a secular youth festival on the same day. For example, this day is not multiplied in the case of twins’ communion.
Under what conditions is remuneration maintained?
To benefit from short leave while keeping their remuneration, your worker must meet the following conditions:
- Notify you in advance, or at least as soon as possible
- Use this leave only for the event for which it is granted
- Experience a loss of salary due to their absence
You cannot prevent your worker from exercising their right to short leave. However, you are entitled to request proof.
