What is a spot check?
A spot check is a scheduled inspection of social legislation and labour regulations. These checks serve an informative and preventive purpose; however, in cases of serious violations, the inspection services will take decisive action and may prepare a report. By notifying companies in advance of the checks, the inspection services aim to prevent social fraud and encourage prompt compliance with regulations.
What is being checked?
In addition to violations related to undeclared work (RSZ declaration) and illegal employment (single permit, work cards, and permits), social inspectors will examine the following aspects within your enterprise:
- The labour regulations, including all work schedules and mandatory annexes (such as the annex on psychosocial risks)
- The labour contracts and annexes (part-time contracts, student contracts, temporary work contracts)
- The control cards of unemployed workers
- The Dimona declaration
- The industrial accident insurance
- The proof of work declaration (AVW) and Checkin@work (C@W)
- …
The inspectors will also verify whether there is any (fictitious) self-employment within the enterprise.
The Social Information and Investigation Service (SIOD) provides various checklists of documents that a social inspector may request during an inspection. These checklists enable you to conduct a form of self-assessment.
For the electrotechnical sector a new checklist was developed last year. The checklist for the metal and technology sector has been updated. The checklist for the construction sector remains unchanged for the time being.
