Frequently asked questions concerning occupational accidents insurance

An employee posted abroad suffers an occupational accident. Is this covered under the Occupational Accidents insurance?


Yes, on condition that the employee is covered under Belgian social security.
 

  • For short foreign assignments: always.
  • In case of secondment: As long as the Belgian employment contract continues to be applicable and the maximum duration of the secondment itself is not exceeded.

The insurance premium increases upon employment abroad, in the following two cases:

  • Your employee runs a higher risk (dangerous work, war zone, long-term assignment, etc.).
  • Your employee was not insured for professional transport in Belgium (he always is when abroad).

We thus always recommend getting additional insurance cover for Private Life.

Is your employee no longer covered under Belgian social security? Then the cover of the occupational accidents insurance no longer applies. In order to continue the cover, you would do well to conclude a collective policy covering Occupational Accidents.

 

Does the Occupational Accidents insurance also cover accidents during outdoor and teambuilding activities?


Yes, if the employee was morally obliged to take part in the activity and the accident occurred during the activity or on the road to and from the activity. The situation itself will play an important role in the evaluation.

Does the activity entail a specific additional risk? Then an additional premium will cover this risk.

 

Are legally cohabiting partners covered under the Occupational Accidents Insurance?


Yes, as long as they comply with the three following conditions:

 

  • The legal cohabitation is registered at the Registrar's;
  • The cohabitation agreement has been drawn up by a notary public and is registered in the Population Registry;
  • The agreement includes a clause regarding obligation to provide help, even after a possible break-up.

If these three conditions have not been met, the surviving partner is not entitled to a benefit from the Occupational Accidents insurance.
